A BLACKBURN takeaway has been hit with a fine and costs totalling £1,082 after pleading guilty to dumping waste in a street.

Chester’s Chicken owners Major Bite (Blackburn) Ltd admitted disposing of fat and oil in a rear alley, in September last year.

Blackburn Magistrates’ Court heard that a complaint was made by a member of the public that Chester’s Chicken, at 12 Copy Nook, was leaving the waste in the rear alley, which was then investigated by a council officer.

Director of the company, Khalid Yussuf, pleaded guilty to the charge of failing to comply with a section 34 notice of the Environmental Protection Act 1990 – not providing waste documentation for the disposal of their trade waste from the premises.

The company was fined £360, with costs of £707.16 and a victim surcharge of £15.

Sayyed Osman, director of environment, housing and neighbourhoods at Blackburn with Darwen Council, said: “I hope this sends a very clear message to anyone involved in a food business, whether they are the day-to-day operators or not, that they must maintain the highest standards.

“There is plenty of help and advice available from the council and no need for premises to dispose of waste like this.”

The court also heard that messages about the inspection, or notice, at Chester’s Chicken were not passed on to the director, and it was also stated that there was a transfer agreement in place.

The court was presented with an agreement running from January 2011 to December 2011.

It was denied that any fats, or oils, were being poured into the back alley.

Chester’s Chicken, which is no longer in business, is not linked to Chester’s Great Tasting Chicken, at 8-10 Copy Nook.
