POLICE saw one man kicking another on the floor during an altercation outside the Flying Haggis in Church Street, Blackburn.
But magistrates heard the victim' did not wish to make a complaint of assault against Ryan Paul Gallagher, who was arrested after a chase through the Cathedral Grounds.
Gallagher, 20, of Sarmatian Fold, Ribchester, pleaded guilty to using threatening behaviour.
He was given a conditional discharge for two years and ordered to pay £45 costs.
Jonathan Taylor, defending, said the incident had started inside the pub when the other man had thrown the first punch.
They were both thrown out by bouncers and it was the other man who again started the fighting.
"My client accepts he then went too far but it is significant the other man didn't want to make a complaint of assault," said Mr Taylor.
"I can only assume it was because he was responsible first of all."
