A MAN who keeps making scenes and upsetting the public asked a judge to cut a 12 hour a day curfew, but was out of luck.
Richard East, 39, had earlier been given the four month 6pm to 6am daily order after admitting four charges of being drunk and disorderly.
His barrister told an appeal hearing it did not stop East drinking as he went to Tesco before 6pm, bought his alcohol and stayed at home drinking. The appellant had wanted less hours indoors but Judge Philip Sycamore, sitting with two justices, said he had caused distress to people, including neighbours and Christmas diners in a restaurant and abused the police.
The judge added: "Carry on drinking this way and you will probably drink yourself into an early grave."
East, of Pine Street, Nelson, had his appeal against the sentence by Burnley magistrates dismissed. He must pay £100 costs.
Richard Bennett, for East, said he had a formidable and unenviable record because of his addiction to drink.
The barrister went on: "It doesn't prevent the appellant from drinking alcohol. It may afford some protection to the public if he abides by it. At least he will be away from members of the public, but it's not addressing the problem itself."
