A LABOURER who stole from a garage and then tried to get a refund was warned that custody awaited if he struck again.
Burnley magistrates heard how one-time drug addict Jason Jeremiagh O'Leary, 29, had previously been diagnosed with kleptomania but medics now believed he had an anti-social personality disorder. He had a record for doing similar things.
The defendant, of Westmorland Street, Burnley, was convicted of theft and allegations of attempted deception on January 20.
He was given 200 hours community punishment and told to pay £8.99 compensation and £50 costs.
The chairman told the defendant the bench was disturbed by the number of similar offences but after reading pre-sentence and psychiatric reports felt they could impose the community order.
She warned O'Leary: "If you come back to court for any offences at all you could find yourself going to prison."
