A TEENAGER racially abused a cabbie, kicked his taxi and then later assaulted him, magistrates heard.

Kimberley June Dewhurst, a former bar worker, had never been in trouble before but certain doors in life were now closed to her after getting a criminal record.

The defendant, 18, of Kinross Street, Burnley, admitted common assault and racially aggravated damage. She was given an 18-month conditional discharge with £200 compensation.

Sophie Lorimer, prosecuting, told the court victim Anzar Ali worked for A and B Taxis. He had been paid to take a fare to Melrose Avenue, Burnley, and four or five people got in his vehicle.

Mr Ali told the group at least one would have to get out as the cab was only licensed for four and the defendant was offensive to the driver and "told him to get back where he came from". She was told to get out of the taxi and then kicked it.

Mrs Lorimer said the driver took his passenger to Melrose Avenue and when he returned to the rank Dewhurst was still there.

She claimed she had left her phone in the cab, accused Mr Ali of pinching it, swore at him and then pushed past him, striking him on the nose. The defendant had no previous convictions.

Dylan Bradshaw, defending, said the crown accepted the assault was not deliberate.

Dewhurst, who had been out with friends, apologised to everybody involved for the regrettable incident.

Mr Bradshaw added: "Certain doors are now closed to this young lady. Drink played a part. It should simply have been a case of getting a taxi home."
