A DRINK driver caught out the afternoon after the night before has been banned for 16 months.
Burnley magistrates heard how Terence McDermott, 36, was stopped by police doing a random check.
The bench told him they accepted he had been ignorant of the effects of alcohol in the body.
McDermott, of Greenock Close, Burnley, admitted driving with excess alcohol and failing to surrender. He must also pay £100 fine and £55 costs.
Mercedah Jabbari, prosecuting, said police followed McDermott on Branch Road and spoke to him.
He smelled of drink, gave a positive roadside breath test and was arrested.
John Nuttall, defending, said McDermott had been out the night before.
He had had no breakfast or lunch and in the afternoon went out and had two pints. He fully co-operated with police.
