A WOMAN who blames devastating knee injuries on a "raised flagstone" in her back garden has won the right to claim compensation from Chorley Council.
Neina Graham, 35, of Church Street, Whittle-le-Woods, twisted her knee in the accident in August 1999, and was in such extreme pain medics had to give her morphine.
She is suing Chorley Council, claiming she tripped over a raised garden flagstone about which she had complained twice before.
The council denies all liability in the case and, in March last year at Preston Crown Court, Judge Appleton threw out Ms Graham's claim.
But Appeal Court judges have now overturned Judge Appleton's decision.
