A MAN was punched by a neighbour after complaining over loud music.

Raymond Ferguson suffered a broken nose and had to see an ear, nose and throat specialist, after he was struck by John Coupe, Burnley magistrates heard.

Coupe, 35 of Barley Street, Padiham, was fined £100 with £300 compensation and £45 costs, after admitting assault causing actual bodily harm.

Prosecutor Michael Travers said Coupe's girlfriend had been involved in an incident with Mr Ferguson's wife and sister-in-law.

Mr Ferguson heard music coming from Coupe's house, the duo argued and Coupe punched Mr Ferguson.

Philip Turner, defending, said there was no doubt Coupe punched Mr Ferguson. He had been working nights and was in bed.

Mr Ferguson's wife and sister-in-law had been arrested and he arrived at Coupe's door not long afterwards - threatening, insulting and under the influence of drink.

Coupe denied the music had been loud and invited Mr Ferguson in for a cup of tea to calm him down but Mr Ferguson was asking Coupe to go outside on the street.

Mr Turner added: "This incident was not of my client's making.

" He was subjected to a considerable amount of provocation.

"The assault was not sustained or premeditated, there were no weapons and by no means a vulnerable victim."
