A YOUTH who broke a man's cheekbone in an unprovoked attack has started a nine-month term of detention.
His victim had to have five weeks off work after the assault as he waited for a taxi in Barnoldswick.
Nicholas Mallaburn, described by character witnesses as 'a caring youth,' was told by a judge he had resorted to violence in temper or drink.
Recorder John Phillips said he was not satisfied the offence was 'out of character,' though he accepted Mallaburn helped his parents and others.
Mallaburn, 19, of Coates Avenue, Barnoldswick, was convicted at Burnley Crown Court of inflicting grievous bodily harm.
Prosecutor Peter Rothery said a Mr Green was standing at the bus stop after a night out. Mallaburn punched him in the right eye causing him to fall backwards. Mallaburn ran off and police were called.
Mr Green was taken to hospital where he was found to have a fractured right cheekbone, which needed a titanium plate.
Robert Elias, defending, said testimonials on Mallaburn's behalf and his pre-sentence report painted a picture of a young man far removed from the annals of violence.
He spent a large part of his life looking after his infirm parents and the consequences of him going to custody would be disastrous.
Mallaburn was clearly a young man with a temper he needed to control.
Mr Elias added Mallaburn, a bricklayer, had lost his job, but would be able to find other work.
He committed the offence probably in drink and the risk of his re-offending was considerably reduced because of the pressure of his court appearance.
Mr Elias asked the judge to pass a sentence other than immediate custody as an "act of mercy."
