PENDLE MP Gordon Prentice has accused the Government of robbing personal injury victims of millions of pounds each year by clawing back state benefits paid to them.

"People who have suffered from a disabling accident are hit for a second time when their compensation goes straight into the Treasury coffers," he said.

"I have a number of constituents who tragically are victims of the Compensation Recovery Unit and have lost thousands of pounds."

Mr Prentice said the highest amount recovered from a victim was £93,950.

He added: "There are people here in Pendle as elsewhere who feel cheated and robbed. The system is crying out to be changed."

Under the 1989 Social Security Act, the DSS can reclaim a range of state benefits paid to a victim of injury or ill health who has won more than £2,500 in legal damages as a result of a personal injury claim.

The cash is deducted from the award before it is paid to the victim and various benefits paid by a certain date, including Income Support, Unemployment Benefit and Disablement Benefit, are also taken out.
