PROTESTERS opposing the planned Broughton by-pass near Preston were delighted when councillors backed their fight - but the move might be illegal.
Lancashire County Council plans would mean a dual carriageway being created to the east of Broughton linking the A6 with Whittingham Lane.
Villagers say it is unneccessary and would increase traffic and pollution.
And behind closed doors at a council meeting last week councillors including Andy Campbell and Terry Cartwright said the land should be earmarked as countryside.
Councillor Cartwright said: "The county is forcing it on us. I feel they are not listening to the people."
But it appears Lancashire County Council has the right to tell the council the land has to be used for the by-pass because of rules laid down in the Local Plan.
Villagers are hoping the council's view will be upheld but it is now up to the council barrister to decide on the legality of their decision.
Janet Nelson, member of campaign group Concern for Broughton, said council support was essential but whatever the outcome they would not give up the fight.
She said: "Most of the village is against the by-pass."
