THE CASE against a Hyndburn chemical company, which faces prosecution after a leak of toxic gas, has been adjourned.
Representatives of Nipa Laboratories, of Nook Lane, Oswaldtwistle, were due to appear before Hyndburn magistrates yesterday to face charges brought by the Environment Agency and the Health and Safety Executive.
But the hearing was cancelled and a new court date has been set for September 6.
The charges relate to a gas leak at the Oswaldtwistle plant in May 1998 when residents complained of stinging eyes and sore throats.
The company is charged with five offences of failing to comply with conditions of its operating licence.
It is also charged with failing to ensure the health and safety of its employees and failing to ensure non-company employees were not exposed to health risks.
