AN angry dad attacked a 13-year-old boy after his daughter arrived home injured and in tears, a court heard.

Burnley magistrates were told how Gary Turner, 40, grabbed hold of the youngster by the scruff of the neck and threw him to the ground.

Turner, of Oxford Road, Burnley, was conditionally discharged for six months, after admitting assault. The bench made no order for compensation as magistrates agreed that Turner had been subject to "quite a lot of provocation".

Andy Robinson, prosecuting, said the victim had been playing with a stick which accidentally struck Turner's daughter.

She went home and about 30 seconds later, Turner came out of his house and shouted to the 13-year-old, who ran off. The defendant followed the teenager and when he got to his back door, Turner grabbed hold of the boy's shirt, pulled him back by the chin, lifted him on to his tiptoes and threw him to the ground.

The defendant told the 13-year-old: "Touch my daughter again and I will kill you."

The victim suffered red marks to his neck.

Alan Wilson, defending, said Turner, a father-of-three, had terrible problems with the boy and the teenager, knowing he could really do nothing about it, had laughed at him.

Turner accepted he lost control in his frustration and grabbed the boy by the scruff of the neck. He threw the boy on to grass, not concrete.

Mr Wilson said there were moves afoot to caution Turner, but when it transpired he had a previous conviction, the custody sergeant felt he could not do so.
