A POLICE woman caught on security camera swearing at a man she was arresting at an Accrington nightclub will not face criminal proceedings.

But the Police Complaints Authority is to carry out its own investigation into the conduct of PC Kate Weaver.

A spokesman for Lancashire Constabulary said: "The Crown Prosecution Service has decided not to initiate criminal proceedings against PC Weaver.

"The matter has now been referred to the Police Complaints Commission for its consideration of disciplinary aspects of the case."

PC Weaver, claimed Tsagher Mahmood, 26, swore at her before his arrest at Afrika's nightclub in Blackburn Road.

But a tape from a club security camera showed her swearing at Mr Mahmood and seizing him by the arm.

Mr Mahmood, of Oxford Close, Blackburn, complained to Lancashire Police and said he intends to sue for wrongful arrest, false imprisonment and malicious prosecution.

A charge of threatening behaviour against Mr Mahmood was dropped by Hyndburn magistrates in February after the video was shown.

A charge of resisting or obstructing a police constable had been withdrawn at a previous hearing.

PC, Weaver, who has remained on duty throughout the investigation, is stationed in Accrington.

Mr Mahmood said this week: "I got a letter from the CPS in York which said they had decided not to carry on with the proceedings.

"I am outraged at the decision.

"I have still got a civil case going against them but she is still on active duty and that hurts.

"The whole thing has affected me badly."

A spokesman for the Crown Prosecution Service said: "We have advised Lancashire Constabulary and Mr Mahmood that there is not sufficient evidence to provide a realistic prospect of a conviction."
