A MAN caught drink driving just two months after he had been banned for a similar offence was sent to prison for three months .
Stipendiary magistrate Jonathon Finestein told Paul John Lynch that his public duty would not allow anything other than a custodial sentence.
Lynch, 45, of Preston New Road, Blackburn, pleaded guilty to driving with excess alcohol, while disqualified and without insurance and to obstructing police.
Daniel King, defending, said that in August Lynch had been the subject of a brutal assault in which he suffered a fractured skull.
"He says his behaviour has been affected by that," said Mr King.
After reading pre-sentence reports Mr Finestein said he was left with a picture of a very lonely man who was drinking more than he should.
"You were banned from driving in September and within two months you are driving while more than twice the legal limit and at the same time you lied to the police," said Mr Finestein.
He added that he had considered putting Lynch on probation but the severity of the offence could only be addressed by a jail term.
