A POLICEWOMAN suffered a painful and bruised shin after a man kicked out at her during an early hours arrest.

Burnley magistrates heard how jobless Jason Black, 29, was out walking his dog when he was told he was going to be locked up.

Black, previously convicted of police assault, was unconditionally bailed until June 21 for pre sentence reports.

The defendant, of Clarence Street, Burnley, admitted assaulting a police constable and resisting a police constable.

Andy Robinson, prosecuting, said police had gone to arrest the defendant after he was accused of criminal damage. There was no evidence to charge him.

When a police van arrived, the defendant lashed out with his leg catching an officer's shin. Black was CS gassed and but still abusive to the officers.

Graeme Tindall, defending, said Black was sorry for his behaviour and thought he had put this sort of thing behind him. The defendant said he was simply walking his dog and was accused by somebody of doing something wrong.

The defendant kicked in the course of a struggle. It was a reckless assault, rather than any deliberate attempt to cause harm as Black was protesting his innocence.
