DEVELOPERS have lodged an appeal against Pendle Council for failing to make a decision about a planning application to build 13 houses on land on Milton Street, Briercliffe.
Although it has a Burnley area address the site is within the Pendle boundary.
The developers have made an appeal against the "deemed" refusal because the application has not been decided within two months.
The Brierfield and Reedley committee will now have to decide on Tuesday whether or not to dismiss the appeal and if so on what grounds.
Objections have been made to the application by Briercliffe Council, Briercliffe Working Men's Club and residents in the Gorple Street and Saxifield Street areas of Briercliffe claiming it would lead to further development in the open fields.
Pendle planning officers are recommending that the committee to make a decision that the planning application would have been refused as the larger part of the planned development is on a greenfield site.
