A MAN who kicked in a glass door at a cafe after staff told him it was shutting, has been sent to jail for two months.

Burnley magistrates heard how Gary Rimmer, 24, who had 14 pints inside him, did a similar thing in a pub after he had made comments likely to inflame rival fans to the team Burnley FC was playing.

Rimmer, of no fixed address, admitted criminal damage and failing to surrender.

Sentencing him, the bench said he had offended whilst subject to several conditional discharges -- one for a similar offence -- and while subject to probation.

They added he was a persistent offender and did not respond to non-custodial sentences.

Philip Potter, prosecuting, said Rimmer was told the cafe was closing and was asked to leave.

He was obviously drunk, talked about football, put two fingers up at staff and then kicked a glass panel in a door.

He had earlier been given a conditional discharge by Meadway magistrates after the Clarets played Gillingham.

The defendant, who was wearing a Burnley FC shirt, was asked to leave a pub. He went, making derogatory comments about Gillingham supporters and which were likely to inflame them. He then kicked a pane of glass, causing it to smash.

Andrew Church-Taylor, defending, said drink had been a problem for some time with Rimmer.

He had had 14 pints before the cafe incident.
