TWO men accused of assaulting another man and leaving him unconscious in the street will not be retried.

Despite two days of deliberations and a majority verdict direction, the jury at Bolton Crown Court failed to reach verdicts on two men accused of the attack following a trial last month. Judge Gillian Ruaux then formally discharged the jury from considering the case any longer, and a re-trial looked possible.

But following a hearing, Neil Toole, 40, of Laurel Crescent, Hindley Green, and Johnathon Gore, 20, of Lord Street, Hindley, will not face retrial after the prosecution offered no evidence and not guilty verdicts were entered.

During the trial, seventeen year-old Darrell Cocklin, of Crossdale Road, Hindley Green, Wigan, had been cleared of unlawfully wounding Neil Yates.

Toole and Gore were each charged with unlawfully wounding Neil Yates on December 19, 1999, after a surprise birthday party at Hindley Conservative Club. Both men had denied the charge.
