A CHILDREN'S dare game ended with a boy having sex with a 10-year-old girl, a court was told.
Burnley Crown Court heard how the boy, then 12 and now 14 years old, was egged on by the girl's 14-year-old brother as they played at the boy's home.
The Burnley 14-year-old and the brother, who is now 15, who a judge earlier ordered should not be named, were each given a 12 month supervision order which he told them was to teach them to know what was right and wrong and to avoid any wrong doing in the future. Both admitted common assault.
Judge Raymond Bennett said the offence arose from a game which went too far. He was quite sure the prosecution had adopted a very proper, public spirited and equitable attitude towards the wrong doing.
Elizabeth Nicholls, prosecuting, said there was a close relationship between all parties in the case. The 15-year-old and his sister were staying at the 14-year-old's home and the children were playing together downstairs whilst the adults were upstairs.
The youngsters were playing a game of truth and dare which began innocently but At some stage the 15-year-old dared the 14-year-old to have sex with his sister.
There appeared to have been some reluctance but the boy did have sex with her and the incident came to an end when the children heard a knock at the front door.
Miss Nicholls said the youngsters carried on their normal relationship and nothing was said about what had happened. In April this year, the girl was approached by school teachers about her behaviour in relation to other matters and she revealed what had happened.
Social services and the police were alerted, the girl's allegations were recorded on a video interview and the two defendants were arrested in May.
The prosecutor said both admitted there had been a game of truth and dare and that the 14-year-old and the girl had been dared to have sex.
