JOHN McSherry, 31, of Bolton Road, Blackburn, was given a conditional discharge for 12 months and ordered to pay £50 compensation and £40 costs by Blackburn magistrates after pleading guilty to damaging a shop door and using threatening behaviour.

A charge of stealing from the shop on Livesey Branch Road was withdrawn.

The court heard that McSherry and another man hadgone idnto the shop and the other man started to take cans of soup from a display.

They were challenged by the owner and after issuing threats McSherry kicked the glass door panel, which cracked.

Roger Pickles, defending, said McSherry had been aggrieved when the shopkeeper accused him of stealing.

It was my client's perception that he was being held in the shop and he became more and more agitated," Mr Pickles told the court.

"He accepts that he kicked the door and that he should have to pay for the damage."
