POLICE and prosecution lawyers are examining new evidence in the case of baby brothers who died within the space of a year -- and are due to make a decision within weeks.

The medical information was compiled following repeated adjournments of the inquest into the death of four-month-old Toby Woods, who died in September 1999.

Toby's mother, Donna Hanson, who lives with partner Robert Woods in Pendle Street, Accrington, was questioned by police in the wake of Toby's death, which came less than a year after his 10-month-old brother Ashley died. A verdict of natural causes was recorded at the inquest into Ashley's death.

Last year police who launched an investigation into the death said there was no evidence for a prosecution although a spokesman for Lancashire Police today said they would examine new reports.

He said: "We are interested in the contents of these reports and are inquiries are ongoing."

And the Crown Prosecution Service revealed it is also looking at the new evidence. A spokesman said: "Inquiries are still ongoing and we are considering new information. We are having a meeting with leading counsel in the next couple of weeks to discuss the matter further."

Coroner Michael Singleton further opened and adjourned an inquest last week until April when the coroner hopes to set a date for a full inquest to be heard.

Mr Singleton said the inquest was adjourned while more evidence was gathered ,which included that of a paediatric pathologist and a paediatrician.

Explaining why he adjourned the inquest a further time Mr Singleton, who admitted this was the longest he had spent on any hearing, said he had a legal obligation.

He said: "There have to be sufficient inquiries. I have to give interested persons adequate opportunity to put before the inquest all the evidence that may be available."

At the hearing Mr Singleton was told that paediatric pathologist Dr Rushton had submitted a report on his findings and an overview of the case had been completed by Professor David, a paediatrician.

Mr Singleton said he hoped to call the pair and a Dr Lloyd to the full inquest.

Donna and Robert have declined to comment about the latest developments.
