A DISC jockey found to be over the limit said he had a lot to drink at his grandmother's funeral the day before and 'topped it up' with several pints, a court was told.

Burnley magistrates heard how Kristian Jordan Stevens, 33, was not insured because he had been saving cash to buy a new car. Stevens, of Oak Street, Colne, admitted driving with excess alcohol and using an uninsured vehicle. He was fined £100, with £50 costs and banned from driving for 12 months.

Tom Snape, prosecuting, said police saw the defendant driving along Skelton Street, Colne and stopped him.

Officers spoke to him and noticed his breath smelled of drink. A roadside test was positive, Stevens was cautioned and arrested and of two further breath tests at Colne police station, the lowest showed 52 microgrammes of alcohol in 100 mililitres of breath -- the legal limit is 35.

Rachel Adamson, defending, said Stevens had been caught out as he was not aware how alcohol could be 'topped up' in his sytem.

The day before, he had had a considerable amount to drink at his grandmother's funeral.

On the day of the offence, he had a couple of pints at lunchtime and in the evening had three pints over a four hour period. He thought the three pints would have kept him within the limit.
