A MAN dying of liver failure was bailed until August 9 for a pre-sentence report, by Burnley magistrates court.
Paul Stanley Brown, 53, was described by his solicitor as "extremely ill and very jaundiced."
Nick Dearing told the court the defendant was not "swinging the lead" but was receiving benefits for the terminally ill and was in the last few weeks of his life.
Mr Dearing said if the court believed custody was the only option it might consider suspending a jail term because of Brown's condition.
Brown, of Heatherbank, Burnley, had earlier been convicted of driving with excess alcohol and otherwise than in accordance with a licence, not having insurance and no test certificate.
He had earlier been given an interim driving ban.
