A FATHER stopped by police said he was having a bad day which started with his wife burning his breakfast.

Burnley magistrates heard how Javaad Daar, 24, had been seen by police not wearing a seat belt and on his mobile telephone.

Daar became agitated, was rude to the police and made a call on his phone telling the recipient the kids had broken his phone, his breakfast had been burned and then he was being arrested for "not being in control of his car or something."

The defendant, of Regent Street, Nelson, admitted threatening, abusive or insulting words or behaviour and was fined £60.

Tom Snape, prosecuting, said the defendant was pulled up on Newport Street, Nelson, who asked why he had been stopped and said it was the third time this week.

Daar said he was having a bad day and became agitated. The officers explained they were giving him a fixed penalty for not being in proper control of the car, but the defendant said he wouldn't give his details because he didn't want to.

He then accused the officers of only stopping him because he was Asian and he made the phone call, shouting and swearing down the phone.

John Nuttall, defending, said Daar had been parked outside his house and a bus behind had flashed him to move on.

He was about to put his seat belt on when his mobile phone rang and he went round the corner and pulled in to answer it. He had been getting out of the way of the bus as soon as he could.
