THE case file of the death of Accrington baby Toby Woods has been passed back to the QC who advised in the initial investigation.
Four-month-old Toby died in September 1999 less than a year after his brother Ashley.
Their mother, Donna Hanson, lived with Toby's father Robert Woods, in Pendle Street, Accrington.She was questioned by police after Toby's death but no charges have been brought by the Crown Prosecution Service.
New evidence, obtained by police after an application made in the High Court for disclosure of documents, has now been passed by the Crown Prosecution Service to David Steer QC.
After he has looked into the new evidence, a meeting will be called of himself, the Crown Prosecution Service and the police before a final decision is made on the case.
Findings from the case of Sally Clark, the Cheshire solicitor acquitted of killing two of her children on appeal, has also been taken into consideration.
