A FATHER of three claiming benefits because he said he was incapable of working was earning cash as a plumber, a court was told.

Burnley magistrates heard Patrick Morley, 34, said to be formerly dependent on drink, lied to the Department for Work for Pensions.

He told them he was not employed and got more more than £2,300 he was not entitled to.

Morley, of Downham Grove, Burnley, admitted three counts of making a false statement or representation to obtain benefit between about February 28 and March 28. He asked for 10 offences to be considered.

The defendant was given a 12 months community rehabilitation order by the bench and must also pay £30 costs.

Paul Wood, defending, said Morley now had his drinking under control, only drank once a week and had a moderate amount of alcohol.

The defendant, subject to a conditional discharge, had made full and frank admissions about the offences.

The solicitor added the money Morley had been overpaid would be reclaimed from him and his financial circumstances were dire.
