DRINK driver Lynn Grunshaw would almost certainly have escaped prosecution if she had taken the advice of a police officer, a court was told.
Blackburn magistrates heard she narrowly failed a breath test and was encouraged by the police to exercise her right to give a blood sample.
Roger Pickles, defending, said the time elapsed before the doctor arrived would almost certainly have resulted in a legal level of alcohol.
"Unfortunately my client was so upset by the whole episode that all she wanted to do was get out of the police station as soon as possible," said Mr Pickles.
Grunshaw, 45, of Tynwald Road, Blackburn, pleaded guilty to driving with excess alcohol and without insurance. She was disqualified from driving for 12 months and fined £100.
