BOSSES at a milk centre in Nelson are to be warned they face prosecution for loading and unloading milk at banned times.
The centre, in Norfolk Street, was granted planning permission in 2001 with conditions that it should not be open for deliveries or distribution between 9pm and 6.30am, 8am and 9am or 3pm and 4pm.
A complaint was made to Pendle Council in September last year that residents were being disturbed in the early hours by activity at the site. Spot checks by council officers on November 26 and December 10 found activity beginning at 5.13am and 6.03am.
Councillors on the Nelson Committee voted to serve a Breach of Condition notice on the owner, meaning he would face prosecution in four weeks unless the activity stopped.
