A MOTORIST was dragged from his car, attacked twice and left injured after he was set on by a gang armed with weapons in a Burnley street, a jury was told.

The town's crown court heard how Moklis Miah, who had been on his way to work with a colleague, was subjected to "totally unnecessary and unlawful" violence at the hands of Badrul Alam, 19, Alamin Hussain, 18, and brothers Ajad and Ahad Miah, aged 18 and 20.

After the first beating the gang fled but then returned and assaulted both Mr Miah and his nephew, who had come to help him. One youth was armed with a belt, another with an iron bar and one had a knife although he didn't use it.

Alam of Dukes Brow, Blackburn, the Miahs of Sterling Street, Oldham, and Hussain of Queens Avenue, Chester, all deny assault causing actual bodily harm and affray, last November 26.

Tim Ashmole, prosecuting, told the jury Mr Miah was at a junction near Brougham Street when a vehicle going in the opposite direction drew alongside him. The occupants were abusive, got out and dragged the alleged victim from his car.

Mr Miah was then kicked and punched and suffered cuts and bruises to his face and head. The gang fled and Mr Miah was joined by his nephew who came to his aid.

The defendants then returned and the two men were attacked by the gang, now armed with weapons.

Mr Ashmole said over the next two or three days, the defendants were arrested and interviewed at the police station.

Alam told officers he had been in the car and Mr Miah had got out of his vehicle and assaulted him. He claimed he was acting in self defence. Alam said he swung punches, was stopped by others from being more violent but did not take part in the second incident.

Ajad Miah told police Mr Miah had a knife and tried to stab his brother. He alleged he was acting as peacemaker.

The prosecutor said Hussain admitted being in the car. Hussain told police Mr Miah got out of his car, grabbed Badrul Alam and there was a scuffle. He denied any assault. Ahad Miah denied to the police he had acted in any violent way.
