A 35-YEAR-OLD man has been cleared of attacking his wife's boyfriend and later threatening a witness with death.
Andrew Clay was found not guilty of assault causing actual bodily harm and witness intimidation at Burnley Crown Court. Clay, of Sarah Street, Darwen, who had denied the charges. The jury had heard claims Clay had thrown a bottle at John McCaffrey, who was going out with his estranged wife, Pamela, at Darwen Music Festival in May last year.
Mr McCaffrey was said to have suffered a gashed eye which had to be glued at hospital.
Clay was alleged to have seen witness Sarah Smith in a Darwen pub and to have told her: "You get me sent down and I will get somebody to kill you."
Clay had denied to police that he had used a bottle and said the man had approached him.
He said Miss Smith had made up her allegation because she did not want to give evidence.
