A DRUNKEN builder involved in a rumpus in front of a distressed and shaking child wanted to "sort out" his partner, Burnley magistrates were told.
Wayne Hill had thought he could carry on causing trouble as long as the child was taken away, the court heard.
Hill, of Brunswick Street, Nelson, admitted breaching the peace and resisting a police officer.
He was given a 12 months conditional discharge, bound over in the sum of £150 and ordered to pay £50 costs.
Elizabeth Read, prosecuting, said police went to Brunswick Street to find a couple rowing
Furniture had been thrown around and a distressed child was curled up on the settee.
Hill was shouting at the hysterical woman.
He lunged at her and police took hold of him but he struggled and had to be pinned down.
Mrs Read the couple were screaming and when Hill ignored warnings to calm down he was CS gassed.
He then tried to put his partner's face in the spray.
Richard Taylor, defending, said Hill and his partner had too much to drink.
She called the police but did not want to make a complaint.
The solicitor added: " Neither of them comes out of this smelling of roses."
