A MAN has died five months after suffering serious head injuries following an alleged street attack in Burnley.
Today police were due to re-interview a man charged with wounding after the incident and were considering new charges.
Damien Smyth died in Burnley General Hospital after he was discovered with life-threatening injuries in October.
The 29-year-old, of an undisclosed address in the town, was found unconscious by a passer-by in Albert Street, near the junction with Ridge Road at 3am on October 9, 2004.
He was taken to Burnley General Hospital and later transferred to Hope Hospital, in Salford for specialist treatment.
He was transferred back to Burnley where he died on Sunday morning.
Following the incident, police, who have only just released details about the death, launched an investigation and appealed for information to trace Mr Smyth's movements prior to his discovery.
A man was arrested and charged with wounding following the incident. Detectives and the Crown Prosecution Service were today considering whether to review the charges.
The man was being interviewed by detectives in Burnley today and a decision on the charges was expected later today.
He appeared at Preston Crown Court yesterday .
The original trial date on the wounding charge was withdrawn.
A police spokeswoman said: "We can confirm that a 29-year-old man died in Burnley General Hospital on Sunday morning."
