A man spotted by police driving a car with four flat tyres turned out to be more than three times over the drink drive limit.

Blackburn Magistrates' Court heard when he was stopped, Gabriel Petrea and his passenger both smelled of alcohol, and gave a roadside reading more than three times the legal limit.

Petrea, 40, of Lamont Garden, Blackburn, admitted to failing to provide a specimen for analysis at the police station on August 15.

He was bailed for the preparation of a pre-sentence report.

Susheela Regala, prosecuting, said Petrea was arrested after providing a roadside sample of 112 micrograms of alcohol per 100ml of breath, against the legal limit of 35mcg of alcohol per 100ml of breath.

Police stopped his Volkswagen Fox in Belle Vue Street, Blackburn, which was where he failed the roadside test.

The breathalyser procedure was commenced at the police station but Petrea refused to provide a sample of breath.

Jonathan Taylor, in mitigation, said there were some aggravating features and it was accepted that a pre-sentence report would be required.

Petrea will be sentenced at a later date.
