Two former police officers are facing a misconduct hearing after being accused of using excessive force while attending an incident, and failing to disclose body worn video footage during criminal proceedings.

One of the officers is also accused of using behaviour and language towards a member of the public which was or could be perceived to be abusive, oppressive and offensive.

The other officer is accused of entering false information regarding a charging decision on an internal document with the Crown Prosecution Service (CPS).

Former officer McLachlan, whose collar number was 5706, and former officer Kelly, whose collar number was 1647 will face the misconduct hearing at 10am on Monday (December 18), at Ormskirk police station.

A panel, which includes legally qualified chair, Paul Forster; police panel member, Superintendent Claire Cooper-Moore; and independent panel member, Mansoor Shah, will hear evidence against the two former officers and will then need to decide whether their actions amounted to misconduct.

A notice of the misconduct hearing reads: “It is alleged former officer Kelly and PC McLachlan have attended a reported incident and that both have used excessive force, which was not necessary, proportionate or reasonable.

“It is further alleged that former officer Kelly used behaviour and language towards a member of the public, which was or could be perceived to be abusive, oppressive and offensive.

“It is alleged that former officer Kelly and PC McLachlan failed to carry out their duties and responsibilities to the best of their ability by being aware of body worn video footage and failing to take steps to ensure it was disclosed during criminal proceedings.

“It is also alleged that PC McLachlan entered false information regarding a charging decision on an internal document with the CPS.

“In light of the stated conduct, it is alleged that former officer Kelly breached the Standards of Professional Behaviour relating to use of force, authority, respect and courtesy, honesty and/or integrity and duties and responsibilities.

“It is alleged that PC McLachlan has breached the Standards of Professional Behaviour relating to use of force, honesty and/or integrity, duties and responsibilities and challenging and reporting improper behaviour.”

If the allegations are found proven by the panel, the officers will face punishment, which could include immediate dismissal.
