A man damaged a car and breached his restraining order by going drinking with the woman he was not supposed to contact.

Mark Walker had been handed a restraining order in January 2021, but in August last year his victim contacted him, and they met up on August 18 to have a drink together.

Burnley Crown Court heard how at just before 1am on August 19, the pair began arguing in the street, waking one of the residents.

Peter Barr prosecuting said: “A man saw two people in the street - the defendant and the woman.

“The defendant then stormed off and swung his arm into the man’s car window, with the window smashing.”

The police were called, and he was arrested.

Mitigating, Charlotte Phillips said: “The victim was in the process of trying to get the restraining order removed and has not provided a statement in relation to these matters.

“He’s taken full responsibility for the breach and was in a relationship with the woman.”

Recorder Michael Blakey said: “It doesn’t matter that the victim of that order made contact with you or consented to being in your company.

“The breach itself is serious but the circumstances are not, but only an immediate custodial sentence is justified.”

Walker, of Hargreaves Drive, Rossendale, pleaded guilty to criminal damage and breach of a restraining order and was jailed for two months.
