Three men who chased and attacked a lone man into a Burnley takeaway have been handed a total of seven years and seven months in prison for violent disorder.
Mohammed Khan, 24, of James Street, Burnley, was sentenced to 35 months, Faisal Khan, 25, of March Street, Burnley, was handed a 33 month sentence, and Muhammad Hanzhalah was given 25 months in prison for their roles in the attack.
Alamzeb Anwar, 42, of Stafford Street, Burnley, was given an 18 month sentence, suspended for 18 months, and was ordered to attend 20 rehabilitation activity days and undergo 100 hours unpaid work for his part in the incident.
Ayaz Khan, 33, also of March Street, was ordered to complete 100 hours of unpaid work.
The sentences were in relation to an attack that happened in Elm Street, Burnley, on December 30, 2020, which left the victim, John Reynolds, with serious injuries to his lungs, ankle and skull.
Tom Challinor, prosecuting, said shortly after 8pm on December 30, police were called to an incident at Tabi’s Takeaway in Burnley where a large group of males were trying to force their way into the premises having become involved in an altercation with Mr Reynolds, who had run into the takeaway and tried to lock himself inside.
Mr Anwar was seen to chase Mr Reynolds into the takeaway while in possession of a barbell which he used to smash the glass on the door and pushed it through to try and hit Mr Reynolds.
There was a tussle between the two to gain hold of a machete Reynolds was holding. The other men gained access once Mr Anwar had possession of this.
Mohammed Khan was seen to push a large spirit level through the door also in an attempt to hit Mr Reynolds.
He was the first of the group to enter the takeaway and grabbed Mr Reynolds when he tried to jump over the counter before punching and kicking him.
Faisal Khan kicked the door a number of times to try and gain access and once inside punched and kicked Mr Reynolds numerous times while he was on the ground.
Hanzahlah was seen to push the spirit level through the door a number of times and joined in with the others to punch and kick Mr Reynolds.
Ayaz Khan was seen to kick the door once and then enter the takeaway where he tried to take hold of Hanzahlah at one stage, but did not go near Mr Reynolds while inside.
Mr Reynolds suffered a six centimetre laceration to the front of his left ankle, two skull fractures and a large laceration to the back of his head, which were treated at Royal Preston Hospital.
Eleanor Mitten, mitigating for Mohammed Khan, said he was standing outside the Muscle Factory gym, which he owns, when Mr Reynolds came over on his own and lunged at him with the machete.
Khan then picked up the spirit level and others came to his aid.
She added Khan was “growing up and growing out of his previous behaviour" and had intentions to get his life back on track and move away for a criminal lifestyle.
Sarah Magill, mitigating for Faisal Khan, said he had made many changes in his life between the attack and now, having been 22 when it happened and now aged 25.
She added he had already completed 109 out of 200 hours unpaid work for another conviction for which he was only sentenced at the end of January.
Chris Moran, mitigating for Hanzahlah, said many of the defendants are of previous good character and his defendant was only 20 at the time, adding two years between the end of someone’s teens and to now is a big chunk of their life and there has been no further trouble since.
Passing the sentences, Recorder Kevin Slack said: “Shortly after 8pm on December 30, 2020, police were called to a takeaway in Elm Street.
“A male inside the takeaway was on the floor with visible injuries to his head. The window on the door was smashed and there was blood and glass on the floor.
“The takeaway had a CCTV system that recorded what happened. Mr Reynolds ran into the takeaway brandishing a machete while being pursued by a larger group of males. He locked the door and you all started to kick the door.
“Alamzeb Anwar, you can be seen holding a barbell and smashing the window to the takeaway. Several males then use that barbell to try and hit Mr Reynolds.
“A group of males can be seen entering the property, with the notable exception of Anwar.
"Mr Reynolds was then attacked, being punched to the head and body. He falls to the floor and then can be seen being kicked to the head and body.
“The weapons seized were a black machete, handed to the police by Anwar, a spirit level, and a barbell.
“There were other males present who can be seen to punch and kick him numerous times.
“Each of you participated in an event with serious acts of violence and there was targeting of an individual by a group.”
