A MAN who went out to celebrate being given a cancer all clear failed a breathalyser after driving home.

Blackburn magistrates heard a member of the public reported Charles Kenyon after seeing his van clipping the wing mirrors of several parked cars.

Kenyon, 56, of Laburnum Road, Blackburn, pleaded guilty to driving with excess alcohol, without insurance and other than in accordance with a licence. He was fined £200 with £85 costs and £80 victim surcharge. He was banned from driving for 17 months after the court heard he gave a reading of 62 against the legal limit of 35.

David O'Donnell, prosecuting, said Kenyon had been seen clipping wing mirrors on Ormerod Street, Accrington, before mounting the kerb and entering a house.

Rebecca Morton, defending, said her client had a cancerous tumour removed and had been given the all-clear around the time of the offence.

"A friend suggested they go for a drink to celebrate and you have heard the rest," said Mrs Morton.

"He has now discovered another lump and has clearly had an awful lot going on in his life in a short period of time."
