A man who entered a flat and stole a mobile phone from the bed where a woman was sleeping naked with her baby has been jailed.
Jason Ludlum, 51, also stole a nail gun from the property, in Piccadilly Road, Burnley, on August 4, before leaving through an unlocked back door.
Burnley Crown Court heard Ludlum was accompanied by his son (who will be sentenced at a later date), on the night in question, when he entered the property at around 3am.
Prosecuting, Stephen Parker said the victim was on the bed with her seven-month-old baby, and due to the summer heat, was sleeping naked.
Mr Parker told the court: “She woke at around 2.40am to feed the baby and knew it was this time as she checked her mobile phone.
“She fell back asleep with her e-cig and mobile phone close to her.
“She was naked on the bed, and when she woke up, she looked for her phone but couldn’t find it and turned the bedroom upside down, but it was nowhere to be seen.
“The victim told her mum that someone must’ve been in the house, but her mother said she was being silly.”
The court was told the following week the victim purchased a new phone and activated the Find My iPhone setting and discovered that her old phone was in a property round the corner from her house, in Every Street.
Mr Parker continued: “Her father went round to the house to speak with one of the defendants who said he had no knowledge of the phone.
“However, when neighbouring CCTV was checked, low and behold, two people - the defendant and his son - were seen going into the property from the back door which was unlocked.
“The first to enter was the defendant in this case and he was in the property for a few minutes before he leaves.
“The CCTV was circulated amongst the local police and one officer recognised the defendant and he was arrested.”
In a victim personal statement, the woman said she felt “sick” as she had been asleep on the bed “with no clothes on”.
Her statement read: “I can’t believe they were so close to me and so close to my son.
"I am concerned that they have seen me naked and whether or not they have taken photos of me in that condition.
“I have nightmares of men being in my bedroom and my child being taken.”
Ludlum, of Alexandra Close, Clayton-le-Moors, pleaded guilty to burglary and also pleaded guilty to the attempted burglary of the Rossendale Road Service Station on August 17, where he was caught on CCTV trying to enter the premises through a window, an act which was unsuccessful.
This was Ludlam's third burglary offence, which carries an automatic prison sentence.
The 51-year-old, who has 23 convictions for 43 offences was sentenced to two years and eight months behind bars.
