A man involved in a neighbour dispute returned to his home and emerged carrying an axe, a court has heard.

Blackburn Magistrates' Court was told how Modestas Kvauka banged the weapon on a metal fence before walking towards the group of people he had been arguing with.

Kvauka, 35, of Barclay Avenue, Burnley, pleaded guilty to possession of an offensive weapon in a public place.

He was committed in custody to Burnley Crown Court to be sentenced on July 28.

Malcolm Isherwood, prosecuting, said Kvauka was across the road from his home where an argument was going on involving about eight people.

"At some stage he went back into his house and emerged carrying an axe,” said Mr Isherwood.

“He banged the axe on a metal fence and then walked towards the group before being ushered back inside his own home.”

Mr Isherwood said the issue was that it was possession of a weapon in dangerous circumstances.

“He had been having a serious argument and then went to arm himself,” said Mr Isherwood.

Zabair Afzal, mitigating, said his client had become aware of his partner arguing with some people across the road. He went out to ask what the issue was.

“The other people were being aggressive and more and more males were coming out of the house and the situation was getting heated,” said Mr Afzal.

“He picked up the axe but says he had absolutely no intention of harming anyone, he just wanted to scare them.”

Kvauka will be sentenced next month.
