A MAN who failed a roadside breath test also failed to provide an evidential sample at the police station despite three attempts.
Blackburn magistrates heard Lee Flynn had been convicted of failing to provide after a trial.
But Jonathan Taylor, defending, said his client would be appealing against the conviction at the Crown Court.
Flynn, 31, of Beechwood Drive, Blackburn, was banned from driving for three years, made subject to community supervision for 12 months and ordered to pay £625 costs. The disqualification was suspended pending the outcome of the appeal.
