A MAN who was banned from a store abused a shop assistant when she asked him to leave.

Blackburn magistrates heard when the store manager intervened he was threatened and thought he was going to be assaulted by Kevin Duxbury.

Duxbury, 36, of the Islington Motel, Great Bolton Street, Blackburn, pleaded guilty to using threatening behaviour. He was fined £20 and ordered to pay £50 compensation.

Andy Robinson, prosecuting, said the assistant at the Tesco Express on Livesey Branch Road asked Duxbury to leave and he became aggressive and abusive.

"When the manager intervened the defendant approached him and he believed he was going to be hit," said Mr Parker.

"He left but before he did said he would find out where the manager lived with his family and kill them all."

Richard Prew, defending, said his client had an itinerant and chaotic lifestyle.

"I have received information from the Islington that he has been evicted," said Mr Prew.

"He is not able to live at any of the other hostels in Blackburn so he is likely to be back on the street."

Mr Prew said his client had a serious drink problem drinking from early in the morning.

"That is evidenced by this offence which was committed at 9.15 am," said Mr Prew.

"Until he accepts help with his alcohol problem we are just going to be in a revolving door situation."
