A MAN banned from any contact with his ex-partner was found naked in bed with her.

Blackburn magistrates heard police made the discovery just three days after Alan Peter Johnson had been released from prison for offences involving the woman and the authorities.

Johnson, 32, of Cog Lane, Burnley, pleaded guilty to breach of a restraining order and was jailed for 28 days. The court heard he had already been recalled on prison licence and would be in custody until October.

Janice Vallance, prosecuting, said police received a call to say Johnson was with his former partner.

"That was just three days after he had been released from prison for offences against her," said Miss Vallance. "When he was sentenced he was made subject to a 10 year restraining order which expires in May 2031."

She said when police arrived at the address of Cog Lane they could not get an answer and eventually forced entry.

"They found the defendant and the aggrieved naked in an upstairs bedroom," said Miss Vallance. "It is conceded he was at his place of residence and she was not willing to co-operate with the police."

Paulo Passerine, defending, said the couple had been in a relationship for two years and wanted that relationship to continue. She gave birth to a daughter and Social Services told her that if she continued in a relationship with Johnson the child would be taken from her.

"Out of frustration he rang his partner, Social Services and the Probation Service and he was abusive," said Mr Passerini. "That resulted in a conviction for malicious communications and the restraining order. They were found in bed together at his house and she refused to make a statement."
