A CLUBBER who attacked another man outside a nightspot, leaving him with a smashed finger and suspected broken nose, was spared jail.

Burnley magistrates heard how Michael James Butson, 28, had set about Stuart Jolley after the victim was said to have assaulted him and been thrown out of the premises.

All Mr Jolley could remember was having "a good night" and the next thing he knew he was waking up in hospital., the court heard.

He did not know what happened, but his clothes were covered in blood, his nose was swollen and he couldn't move two fingers on his right hand.

The court was told how Mr Jolley fell to the ground after being shown the door at the club and Butson "gave him a kicking" as he was "completely helpless" and no threat to him at all.

Butson, of Arkwright Street, Burnley, admitted assault causing actual bodily harm on August 26. He was given a community order with 18 month supervision and 150 hours unpaid work. The defendant must also pay £75 costs and £100 compensation.

Nick Dearing, defending, said the Probation Service did not consider Butson to be dangerous.

The solicitor said the defendant, who had a stable job "took a chance to get a kick in before he ran off."
