A MOTORIST has been cleared of taking a car which was involved in a crash outside a Rossendale care home.
But Andrew John Capell, 34, did admit driving with excess alcohol and driving without due care in relation to the crash at Lumb Valley House last July.
Capell, of Staghills Road, Newchurch, was fined £319 with £85 costs and banned from driving for three years after the collision involving a Ford Fiesta ST and the home’s boundary wall.
Prosecutors offered no evidence on a charge that he took the Fiesta without authority before the crash, which was also said to have caused injuries to John Stott.
