A BURNLEY man who ‘flipped’ after being arrested on a night out with friends has been allowed to keep his liberty.
Kurt Swindlehurst, 21, became incensed when he was detained for a public order offence in Burnley’s Hammerton Street.
And while in the back of a police car he managed to kick out one of the back windows, Burnley Crown Court heard.
He tried to kick out a second window before he was subdued with pava spray by officers, the court was told.
Just two days before Swindlehurst, 21, of Cog Lane, Burnley, had appeared before the crown court, where he received a 12-month suspended prison sentence for leading police on a 60mph chase through residential estates.
Richard Taylor, defending, said police had not made it clear Swindlehurst was being arrested for an old offence, and not his behaviour that night.
The defendant had carried out three-quarters of a 200-hour community service order in just two months, which sentencing Judge Beverley Lunt said was ‘phenomenal’.
The judge conditionally discharged him for 12 months after he admitted criminal damage.
