A BEDROOM bust-up ended with a man being arrested and charged with assault.
Blackburn magistrates heard Daniel Fainam, 28, was asleep in bed when his partner came home from a night out and climbed in beside him.
She pushed him because he was sprawled across the bed and he grabbed at her and pushed her, causing her to fall out of bed.
She called the police and Faina was arrested and spent the night in a police cell.
Faina, of Wessex Close, Accrington, admitted assaulting Laura Bland.
He was given a conditional discharge for 12 months and ordered to pay £100 costs.
Philippa White, prosecuting, said the couple had argued earlier in the evening and Faina stormed off.
Miss Bland, who said in her statement he had never been violent towards her, went out with friends and he was in bed when she returned.
Gareth Price, defending, said there was an adage you shouldn’t go to sleep on an argument. He said: “This is a prime example. It began as a very silly argument about which CD to play in the car and they went their separate ways.
“He accepts he pushed at her and she fell out of bed but he did not follow her downstairs. He simply got dressed and presented himself to police when they arrived.”
